Direct translation for Q2 from HR text book



Q2- Talk about the protection of right to life especially in Islam
  1. The most fundamental part of human rights which is protected by Islam is the right for living
  2. Therefore, taking one’s life or simply killing/murdering is forbidden and it is punishable by capital punishment
  3. Killing human being is banned in Islam and it is considered as a sin that can result in divine retribution


A. KILLING/MURDERING PROHIBITION & ITS PUNISHMENT
  1. Muslim jurist agreed upon prohibition of murder & killing & it is one of the greatest sin after non-believing in Islam. God has said… (refer surah al-Isra’ verse 33)
  2. Islamic law has laid upon us the rule against murder which is al-Qisas. God has said… (refer surah al-Baqarah verse 178)
  3. The reason/reflection of enforcement of Qisas is: 
      • To prevent the crime 
         For example is a person who intended to kill others might cancel his/her intention if he/she thinks or learn about the consequences of murder/killing
     • To prevent further wrongdoing
   4. In Islam, murder is considered a sin. God said… (refer surah an-Nisa’ verse 93)


B. PROHIBITION FROM COMMITTING SUICIDE & ITS PUNISHMENT IN THE HEREAFTER
  1. For whatever the reason maybe, committing suicide is not allowed by Islam
  2. It is because a person’s life doesn’t belong to that particular individual. The life itself is given by Allah & therefore, every human being must be responsible for it, preserve & protect it
  3. God has said… (refer surah an-Nisa’ verse 29, al-Baqarah: 195, as-Syura’: 49-50)
  4. The Prophet has made clear about the consequences of suicide (refer HR book pg 118; 5)


C. PROHIBITION OF ABORTION & ITS CONSEQUENCES
  1. The right for living in Islam also applies for the fetus in mother’s womb
  2. Therefore, it is forbidden to abort pregnancy after the spirit (ruh) has already been blown into the fetus
  3. If the fetus is dead after abortion, then compensation is a must
  4. If the fetus aborted is living, blood-money must be given


D. PROHIBITION FROM KILLING CHILDREN & BURY FEMALE CHILDREN ALIVE
  1. Killing children & bury female children alive is strictly forbidden in Islam no matter for what reason even though they may cause financial burden to parents
  2. God has said… (refer surah al-Isra’ verse 31)
  3. Regarding to bury female children alive, God has said… (refer surah at-Takwir: 8-9)


E. EQUAL PROTECTION FOR BOTH MUSLIM & NON-MUSLIM
  1. Islam doesn’t discriminate which party either Muslim & non-Muslim should get better security protection
  2. It guarantees the equal rights for both Muslim & non-Muslim in getting security protection
  3. Prophet has said… (refer HR book pg 119; 4)


F. HUMAN SECURITY AGAINTS PHYSICAL & NON-PHYSICAL HARM/DANGER
  1. Islam protects human life from any action that may endanger it either:

     • Physical such as beating, injury, torture, etc
     • Non-physical such as insult, slander, vilify, etc


G. SELF PROTECTION
  1. Islam provides human the right to protect themselves
  2. Given a situation, if a person is threatened to be killed, he may do whatever it takes to defend himself even he have to kill the assaulter
  3. It was narrated that a man went to see the Prophet & said… (refer HR book pg 120; 2)
